DUI Convictions

The following are convictions made for driving under the influence with a blood-alcohol content of 0.08 percent or higher or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the following: drug/alcohol evaluations, Victim Impact Panel, Attitudinal Dynamics of Driving, Level II education and therapy, Alive at 25, inpatient and/or outpatient treatment or therapy, and must submit to random tests for drugs and alcohol use. Suspended imposition of additional jail sentence (in parentheses) is conditional upon completing probation successfully and are awarded if all other requirements of the sentence are completed within one year. Dollar amounts are fines and court costs defendants were ordered to pay.

TUESDAY, AUG. 21

cortez colorado Jason Scott Manasco, 37, of Cortez. This is defendantís 2nd DUI conviction. Eighteen days under electronic surveillance, (365 days jail with suspended imposition), 24 months supervised probation, $1,336.50, 60 hours community service.

cortez colorado Travis C. Casey, 35, of Towaoc. BAC over .2. Ten days in jail with 1 day credit for time served, (additional 30 days in jail suspended imposition), 24 months supervised probation, $1,084,50, 24 hours community service.

cortez colorado Michael Lynn Dahl, 62, of Cortez. This is defendantís 7th DUI conviction. One-hundred eighty days under electronic surveillance, (365 days in jail suspended imposition), 24 months supervised probation, $1,959.50, 90 hours community service.

cortez colorado Tim W. Hall, 53, of Cortez. BAC over .2. Five days in jail, 2 days credit for time served, (30 days in jail with suspended imposition), 12 months private probation, $721.59, 48 hours community service.

cortez colorado Sandra D. Buck, 37, of Bluff, Utah. This is defendantís 2nd DUI. Ten days in jail, (with an additional 365 days in jail with suspended imposition).

DWAI Convictions

The following are convictions for driving while ability impaired with a blood-alcohol content between 0.05 percent and 0.08 percent or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the classes or programs listed above in the DUI category; additional listed conditions also apply.

TUESDAY, AUG. 21

cortez colorado Kaitlyn R. Begaye, 23, of Cortez. Thirty days in jail, ($100 additional fine with suspended imposition), 12 months supervised probation, $654.50, 24 hours community service.

TUESDAY, AUG. 28

cortez colorado Elmer D. Bizaholoni, II, 35, of Mancos. This is defendantís 3rd DUI conviction. Seventy-five days in jail, (additional 365 days jail suspended imposition), 24 months supervised probation, $1,312.62, 90 hours community service.

cortez colorado Jake Emerson, 50, of West Jordan, Utah. This is defendantís 4th DWAI conviction. One-hundred forty days in jail, 5 days credit for time served, (365 days in jail suspended imposition), 24 months supervised probation, $2,513.50, 90 hours community service.

Domestic Violence

The following cases of domestic violence require those convicted to attend and complete one or more of these additional classes or programs in addition to jail time, probation, fines and community service: domestic violence evaluation, substance abuse treatment and testing, inpatient treatment and anger management.

MONDAY, AUG. 27

cortez colorado Blanford Kee Harvey, 32, of Round Rock, Ariz. Third Degree Assault ó Knowingly/Recklessly Causing Injury, 24 months supervised state probation, $1,463.50, must obtain a domestic violence evaluation and follow all recommendations and undergo substance abuse treatment and testing as directed by probation, and maintain full time employment.

cortez colorado James R. Kidd, 32, of Dolores. Harassment ó Strike/Shove/Kick, 24 months of probation is REVOKED and terminated as unsuccessful. Thirty days in jail imposed with day-for-day credit with inpatient treatment, $1,291.80.

cortez colorado James R. Kidd, 32, of Dolores. Third Degree Assault ó Knowingly/Recklessly Causing Injury, 180 days in jail, $212.50. Defendant is to receive day-for-day credit for an inpatient treatment program that is successfully completed. He must obtain a domestic violence evaluation and follow all recommendations for treatment.

cortez colorado Vanida E. Buck, 33, of Shiprock, N.M. Harassment ó Strike/Shove/Kick, 43 days in jail, 24 months probation, $1,540.50. Defendant was ordered to obtain domestic violence evaluation and follow all recommendations for treatment, participate in a substance abuse treatment program for alcohol, submit to random tests for drugs and alcohol use as required by probation, no driving without a valid driverís license.

PROTECTION ORDER VIOLATION

WEDNESDAY, AUG. 29

cortez colorado Kenneth Cason, 25, of Cortez. One day in jail with a deferred sentence of 12 months unsupervised probation. $184.50. A deferred judgment is not a conviction; it is a sentence typically put off (deferred) for a specific period of time, typically a year. If the defendant complies with each of the conditions of the deferred sentence within the allotted time period, the defendantís record is cleared of this charge.
