DUI Convictions

The following are convictions made for driving under the influence with a blood-alcohol content of 0.08 percent or higher or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the following: drug/alcohol evaluations, Victim Impact Panel, Attitudinal Dynamics of Driving, Level II education and therapy, Alive at 25, inpatient and/or outpatient treatment or therapy, and must submit to random tests for drugs and alcohol use. Suspended imposition of additional jail sentence (in parentheses) is conditional upon completing probation successfully and are awarded if all other requirements of the sentence are completed within one year. Dollar amounts are fines and court costs defendants were ordered to pay.

TUESDAY, SEPT. 25

ź Jason G. Walrod, 32, of Cortez. This is defendant’s 4th conviction. One-hundred fifty (150) days in jail with 11 days credit for time served (additional 365 days in jail suspended imposition), 36 months supervised probation, $1,367.80, community service 120 hours.

ź Steven A. Marquez, 30, of Cortez. This is defendant’s 3rd conviction. Seventy-five days in jail (additional 365 days in jail suspended imposition), 24 months supervised probation, $2,529.50, community service 90 hours.

ź Frances L. Haskan, 18, of Towaoc. (Thirty days in jail suspended imposition), 12 months probation, $816.50, community service 24 hours.

ź Rexie Martine, 26, of Cortez. Seventy days in jail with 70 days credit for time served, 24 months probation concurrent with case #12T56, $809.50, community service 24 hours.

ź Rexie Martine, 26, of Cortez. Additional charge of Failure to Report Accident. This is defendant’s 2nd conviction. On DUI charge: Seventy days in jail with 70 days credit for time served (365 days in jail suspended imposition), 24 months supervised probation, $1,457.79, community service 48 hours; on Failure to Report Accident charge: 30 days in jail with 30 days credit for time served.

ź Delphina Silas, 20, of Cortez. (Thirty days) in jail suspended imposition, 12 months probation, $1,323.50, community service 24 hours.

DWAI Convictions

The following are convictions for driving while ability impaired with a blood alcohol content between 0.05 percent and 0.08 percent or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the classes or programs listed above in the DUI category; additional listed conditions also apply

MONDAY, SEPT. 24

ź Frank Dean Baty Jr., 39, of Cortez. (Thirty days in jail with suspended imposition), 12 months probation concurrent with Case #11M533, $1,519.50. Additional jail term suspended as long as terms of probation are followed.

TUESDAY, SEPT. 25

ź Norman Haswood, 38, of Window Rock, Ariz. This is defendant’s 2nd conviction. Forty days in jail (additional 365 days jail suspended imposition), 24 months supervised probation, $1,083.50, community service 60 hours.

ź Ashley Atene, 27, of Kayenta, Ariz. Additional charge of Child Abuse - Knowingly/recklessly causing no injury. On the child abuse count, defendant was sentenced to 5 days in jail with 5 days credit for time served, and to 24 months of probation. On the DWAI count, defendant was sentenced to 24 days in jail, with 24 days credit for time served, and 24 months of probation (additional 365 days jail suspended imposition), $2,528, community service 48 hours.

ź Lowery Johnson, 38, of Shiprock, N.M. This is defendant’s 3rd conviction. Seventy-five days in jail with 1 day credit for time served (additional 365 days suspended imposition), 24 months supervised probation, $1,329.50, community service 90 hours.

Domestic Violence

The following cases of domestic violence require those convicted to attend and complete one or more of these additional classes or programs in addition to jail time, probation, fines and community service: domestic violence evaluation, substance abuse treatment and testing, inpatient treatment and anger management.

MONDAY, SEPT. 24

ź Frank D. Baty, 39, of Cortez. Two counts of Third Degree Assault - knowingly/recklessly causing injury. Forty-five days in jail on Count 1, plus 24 months supervised probation; additional 45 days in jail on Count 2, plus additional 24 months supervised probation, $1,639.80. There will be zero tolerance for any violations of protection order.

ź Jon H. Sanders, 29, of Cortez. Harassment - strike/shove/kick. Twelve months supervised probation, $946.80. There will be zero tolerance for non-compliance of sentencing terms.

ź Qi Wu, 44, of Cortez. Child Abuse - knowingly/recklessly causing injury. $412.50.

ź Ronald D. Hardy, 40, of Round Rock, Ariz. Thirty days in jail with 30 days credit for time served, $209.50.

ź Curtis Velasquez, 31, of Mancos. Four days in jail with 1 day credit for time served, $209.50.

FRIDAY, SEPT. 21

ź Nicolas J. Rodriquez, 20, of Durango. Speeding too fast for conditions. $184.50.

MONDAY, SEPT. 24

ź Vernon Jordan Begay, 23. Violation of Bail Bond Conditions - Misdemeanor. One-hundred eighty (180) days in jail, 72 days credit for time served, $209.50.

TUESDAY, SEPT. 25

ź Clifford C. Phillips, 50, of Cortez. Driving After Revocation Prohibited (Habitual Traffic Offender), Case #521. Sixty days in jail, $209.50, community service 100 hours.

ź Clifford C. Phillips, 50, of Cortez. Driving After Revocation Prohibited (Habitual Traffic Offender), Case #349. Sixty days in jail, $209.50, community service 100 hours.

ź Renwick W. Jacket, 54, of Towaoc. Driving After Revocation Prohibited. Thirty days in jail with suspended imposition, $1,271.50, community service 300 hours. (An additional fine of $3,000 is suspended as a condition of completing sentencing requirements.)

ź Roger Stratton, 53, of Dolores. Driving Under Restraint - Alcohol-Related. Thirty days in jail, $209.50.

WEDNESDAY, SEPT. 26

ź Wilson Mark Shanafelt, 24, of Farmington, N.M. Disorderly Conduct - Fighting in Public. $284.50.
