DUI Convictions

The following are convictions made for driving under the influence with a blood-alcohol content of 0.08 percent or higher or by prescription or illegal drugs. All convicts were ordered to obtain and follow one or more of the following: drug/alcohol evaluations, Victim Impact Panel, Attitudinal Dynamics of Driving, Level II education and therapy, Alive at 25, inpatient and/or outpatient treatment or therapy, and must submit to random tests for drugs and alcohol use. Suspended imposition of additional jail sentence (in parentheses) is conditional upon completing probation successfully and are awarded if all other requirements of the sentence are completed within one year. Dollar amounts are fines and court costs defendants were ordered to pay.

TUESDAY, SEPT. 25

cortez colorado Jason G. Walrod, 32, of Cortez. This is defendantís 4th conviction. One-hundred fifty (150) days in jail with 11 days credit for time served (additional 365 days in jail suspended imposition), 36 months supervised probation, $1,367.80, community service 120 hours.

cortez colorado Frances L. Haskan, 18, of Towaoc. (Thirty days in jail suspended imposition), 12 months probation, $816.50, community service 24 hours.

cortez colorado Rexie Martine, 26, of Cortez. Seventy days in jail with 70 days credit for time served, 24 months probation concurrent with case #12T56, $809.50, community service 24 hours.

cortez colorado Rexie Martine, 26, of Cortez. Additional charge of Failure to Report Accident. This is defendantís 2nd conviction. On DUI charge: Seventy days in jail with 70 days credit for time served (365 days in jail suspended imposition), 24 months supervised probation, $1,457.79, community service 48 hours; on Failure to Report Accident charge: 30 days in jail with 30 days credit for time served.

MONDAY, SEPT. 24

cortez colorado Frank Dean Baty Jr., 39, of Cortez. (Thirty days in jail with suspended imposition), 12 months probation concurrent with Case #11M533, $1,519.50. Additional jail term suspended as long as terms of probation are followed.

TUESDAY, SEPT. 25

cortez colorado Norman Haswood, 38, of Window Rock, Ariz. This is defendantís 2nd conviction. Forty days in jail (additional 365 days jail suspended imposition), 24 months supervised probation, $1,083.50, community service 60 hours.

cortez colorado Ashley Atene, 27, of Kayenta, Ariz. Additional charge of Child Abuse - Knowingly/recklessly causing no injury. On the child abuse count, defendant was sentenced to 5 days in jail with 5 days credit for time served, and to 24 months of probation. On the DWAI count, defendant was sentenced to 24 days in jail, with 24 days credit for time served, and 24 months of probation (additional 365 days jail suspended imposition), $2,528, community service 48 hours.

Domestic Violence

The following cases of domestic violence require those convicted to attend and complete one or more of these additional classes or programs in addition to jail time, probation, fines and community service: domestic violence evaluation, substance abuse treatment and testing, inpatient treatment and anger management.

MONDAY, SEPT. 24

cortez colorado Frank D. Baty, 39, of Cortez. Two counts of Third Degree Assault - knowingly/recklessly causing injury. Forty-five days in jail on Count 1, plus 24 months supervised probation; additional 45 days in jail on Count 2, plus additional 24 months supervised probation, $1,639.80. There will be zero tolerance for any violations of protection order.

cortez colorado Jon H. Sanders, 29, of Cortez. Harassment - strike/shove/kick. Twelve months supervised probation, $946.80. There will be zero tolerance for non-compliance of sentencing terms.

cortez colorado Qi Wu, 44, of Cortez. Child Abuse - knowingly/recklessly causing injury. $412.50.
